Terms and Conditions for Hosting Services

MJ Digital Design, Stjepana Mokrovića 8, 10299 Marija Gorica OIB: 27653647316 (hereinafter referred to as MJ DIGITAL DESIGN / Owner), provides web hosting services under these Terms and Conditions (hereinafter referred to as the ‘Terms’). By using our hosting services, you agree to be bound by these Terms. These Terms have been formed in accordance with applicable Croatian and European regulations. MJ DIGITAL DESIGN reserves the right to modify these Terms at any time, with notice provided to users as specified herein. 1. Service Agreement and Duration

1.1. Service Period

The hosting service is contracted for the period specified on the invoice issued by MJ DIGITAL DESIGN. The service period begins on the date of activation and continues for the duration specified in your service package.

1.2. Renewal

Services will automatically renew for the same period unless cancelled in accordance with the cancellation terms specified in these Terms. You will be notified of upcoming renewals and any changes to pricing or terms at least 30 days in advance.

1.3. Cancellation

You may cancel your hosting service at any time by sending a written cancellation request via email to hello@mjdigitaldesign.com. Your cancellation request must include your account information, clearly state your intention to cancel the service, and specify the date on which you want the service to be cancelled. Only future dates are accepted for cancellation requests. If you request a refund upon cancellation, you must also provide your IBAN (International Bank Account Number) where the refund should be processed. The refund process is detailed in section 10.3 of these Terms. Please note that refunds are only available for prepaid periods that have not yet been used, and the refund calculation includes a deduction for setup costs as detailed in the refund policy.

2. Service Specifications and Limitations

2.1. Bandwidth and Traffic

Traffic is unlimited, with fair usage policy for outbound traffic. The fair usage limit for outbound traffic in your package is 5TB per month. In case of higher outbound traffic, we reserve the right to throttle data transfer until you upgrade to a custom package with resources appropriate for particularly high traffic.

AURORA 100 – The enterprise package

100GB NVMe SSD Disk Space
10 Domains
10 Databases
Unlimited Email Accounts
Price: €298.50 per year

Each mailbox may have unlimited aliases. All packages include unlimited bandwidth subject to fair usage policy as specified in section 2.1.

2.3. Resource Usage

You agree to use server resources provided by MJ DIGITAL DESIGN for your business needs in a reasonable manner. Prohibited activities that constitute a violation of these Terms include:

Sending mass unsolicited email messages (Spamming)
Continuous processor or disk-intensive operations (Crypto mining)
Any other use of server resources outside the scope of the contracted service

3. Email Services and Security

3.1. Email Protection

Your email mailboxes are protected by antispam and antivirus protection; however, MJ DIGITAL DESIGN cannot guarantee absolute security. We always recommend caution when opening links and attachments from unverified sources.

3.2. Account Security

You are obligated to take appropriate measures to prevent misuse of your user accounts. This particularly includes, but is not limited to:

Setting a password to protect your account that is not easy to guess
Not disclosing your password to third parties, whether verbally, in writing, or through electronic communication channels

MJ DIGITAL DESIGN will never request your username and password via email. If you receive communication requesting entry of your username and password outside the official company websites, you are obligated to report such fraud attempts to abuse@mjdigitaldesign.com.

4. Service Availability and Technical Support

4.1. Service Availability

MJ DIGITAL DESIGN is obligated to remove any technical difficulties on servers in the shortest possible time and is obligated to notify you if service degradation has occurred due to server difficulties. The guaranteed monthly service availability is 99.97%.

4.2. Maintenance and Downtime

We reserve the right to perform scheduled maintenance that may result in temporary service interruption. We will provide reasonable advance notice of scheduled maintenance whenever possible. Emergency maintenance may be performed without prior notice to ensure service stability and security.

5. Backups and Data Protection

5.1. Backup Policy

MJ DIGITAL DESIGN performs automated backups of your hosting account once daily. These backups are available exclusively through your account control panel and are downloadable. We do not maintain separate backup copies of your websites outside of the automated backup system accessible through your account panel.

5.2. Additional Backup Requirements

If you require more frequent backups (more than once per day) or extended backup retention periods (more than the standard retention period), you must contact us to arrange a custom backup solution. Additional backup services may be subject to additional fees.

5.3. Backup Responsibility

While we perform daily backups, the user is responsible for maintaining their own backup copies of critical data. MJ DIGITAL DESIGN is not liable for any data loss, regardless of the cause, including but not limited to hardware failures, software errors, or backup system failures.

6. Prohibited Content and Account Suspension

6.1. Prohibited Content

MJ DIGITAL DESIGN is not responsible for the content and communications on your websites. The following content is prohibited and constitutes grounds for service termination:

Content that advocates, promotes, or is in the nature of: hate speech, pornography, false or misleading information, harassment of other users
Publication or transmission of content that violates intellectual or commercial rights
Content that is contrary to applicable laws and regulations
Content that in any way threatens the security or integrity of the infrastructure of MJ DIGITAL DESIGN or its contractual partners

6.2. Account Suspension for Unlawful Content

If we identify unlawful, malicious, or otherwise prohibited content on your website or account, we will notify you and request immediate removal of such content. If you fail to remove the prohibited content within 24 hours of our notification, we reserve the right to suspend your account immediately without further notice. During suspension, your website and services will be inaccessible. Suspension will remain in effect until the prohibited content is removed and we have verified compliance with these Terms. Repeated violations may result in permanent termination of services without refund.

6.3. Content Responsibility

You are solely responsible for all content hosted on your account. MJ DIGITAL DESIGN does not monitor content but reserves the right to review content if we receive complaints or suspect violations of these Terms.

7. Changes to Terms and Pricing

7.1. Notification of Changes

MJ DIGITAL DESIGN is obligated to notify you in case of changes to these Terms or service pricing at least 30 days in advance. Changes will be communicated via email to the address on file in your account.

7.2. Acceptance of Changes

Continued use of our services after the effective date of any changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you may cancel your service in accordance with the cancellation terms.

8. Limitation of Liability

8.1. General Limitation

MJ DIGITAL DESIGN shall not be liable for any damage that may occur to you or any third party due to content, communications, or other reasons that may arise in the provision of our services. This includes, but is not limited to:

Data loss or corruption
Service interruptions or downtime
Security breaches or unauthorized access
Loss of business, revenue, or profits
Indirect, incidental, or consequential damages

8.2. Maximum Liability

To the maximum extent permitted by law, MJ DIGITAL DESIGN’s total liability for any claims arising from or related to the hosting services shall not exceed the amount paid by you for the services in the twelve (12) months preceding the event giving rise to the claim.

8.3. Force Majeure

MJ DIGITAL DESIGN shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, government actions, or failures of third-party service providers.

9. Service Termination

9.1. Termination by Customer

You may terminate your service at any time by providing written notice to MJ DIGITAL DESIGN. Termination will be effective at the end of your current billing period, unless you request immediate termination. Upon termination, you may request a refund as stated in section 10.3 of these Terms.

9.2. Termination by MJ DIGITAL DESIGN

We reserve the right to terminate or suspend your service immediately, without notice or refund, if you:

Violate these Terms
Engage in prohibited activities
Fail to pay fees when due
Use the service for illegal purposes
Otherwise breach your obligations under these Terms

9.3. Data Retrieval After Termination

Upon termination, you are responsible for retrieving your data before the termination date. After termination, we may delete all data associated with your account. We are not obligated to retain or provide access to your data after termination.

10. Payment Terms

10.1. Payment Obligations

You agree to pay all fees associated with your hosting service in accordance with the pricing and billing terms provided at the time of service activation. Fees are due in advance for the service period.

10.2. Late Payment

If payment is not received by the due date, we reserve the right to suspend or terminate your service. Service suspension does not relieve you of your payment obligations. We may charge late fees and interest on overdue amounts as permitted by law.

10.3. Refund Policy

Refunds are available upon service termination and are calculated using the following formula: (Package Price – 25% Setup Fee) × (Days Used / 365) Please note: The “setup fee” is a calculation term used solely for refund calculations and does not represent an actual charge. No setup fee is billed to customers for new service packages. This term is used in the refund formula to account for administrative and setup costs when calculating refunds. Refunds are only available for prepaid periods that have not yet been used. No refund will be provided for the billing period during which a free website migration was performed for the user. This applies to the entire billing period in which the migration service was provided, regardless of when during that period the migration occurred.

10.3.1. Refund Process

The refund process follows these steps:

You send a cancellation email with all required details, including your IBAN if requesting a refund.
We review and approve your cancellation request, calculate the refund amount according to the formula above, and send you the calculated refund amount for your approval.
If you approve the refund amount by confirming via email, we will process the refund to your provided IBAN within 30 days from the date we receive your approval email.

10.4. Service Issue Reimbursement

In the event of hosting service issues that result in downtime or service degradation, you may be eligible for reimbursement. Reimbursement is calculated as 1/365 of your annual package price per day of confirmed service issues, provided you contact us to report the issue. Reimbursements will be provided as credit applied to your next billing cycle. To be eligible for reimbursement, you must report the service issue to us within 48 hours of its occurrence. We reserve the right to verify and confirm service issues before granting reimbursement.

11. Intellectual Property

You retain all rights to your content and intellectual property. By using our services, you grant MJ DIGITAL DESIGN a limited, non-exclusive license to use, store, and transmit your content solely for the purpose of providing the hosting services.

12. Privacy and Data Protection

Your use of our hosting services is also governed by our Data Protection and Privacy Policy, which is available separately. We process your personal data in accordance with applicable data protection laws, including GDPR.

13. Dispute Resolution

13.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Croatia.

13.2. Jurisdiction

Any disputes arising from or related to these Terms or the hosting services shall be subject to the exclusive jurisdiction of the competent courts in Zagreb, Croatia.

14. General Provisions

14.1. Entire Agreement

These Terms constitute the entire agreement between you and MJ DIGITAL DESIGN regarding the hosting services and supersede all prior agreements and understandings.

14.2. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14.3. Waiver

Failure by MJ DIGITAL DESIGN to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
